Deterrence is at the core of our criminal justice system. And Plea Bargaining goes against its very core idea by allowing criminals to believe they can work out a plea and therefore be punished less.
Your core here is intuitive. When criminals think they’ll be punished less, they’re more likely to commit crime. Harp on this intuition, make it your strength.
Find examples of when plea bargaining was abolished and the effects of crime decreased, find examples of when plea bargaining was reinstated and there was more crime put in place. Build the contention to make it as robust as possible.
Above all, don’t lose track of your value. You might want to add another value link in order to shore up the defenses. You need to prove that deterrence is the most important thing to consider in the criminal justice system entirely.
